Buildings for Lease or Rent Review

A Buildings for Lease or Rent (BLR) review and approval by the Board of County Commissioners (BoCC) is required when 4 or more buildings for lease or rent are to be created on a single tract of land. Because impacts from leasing or renting buildings on a single tract of land may directly impact a property and its surroundings, the review allows the BoCC to consider and mitigate potential impacts to ensure the protection of public health, safety, and general welfare. Properties with Part 2 zoning are not reviewed under BLR.

Current Buildings for Lease or Rent Regulations

The Community Development and Planning Department (CDP) has begun the process to revise the Buildings for Lease or Rent Regulations (Resolution 2013-17) for compliance with Senate Bill 174 passed during the 2025 Montana Legislative Session, which moved the review for Mobile Home Parks and Recreational Vehicle (RV) Parks from the Subdivision and Platting Act to Buildings for Lease or Rent. Included with these updates are additional development standards, application requirements, definitions, and variance procedures and criteria.

DRAFT Buildings for Lease or Rent Regulations

The BoCC will hold a public hearing at 9:00 a.m. on Tuesday, November 4, 2025, in Room 330 on the third floor of the City-County Building, 316 North Park Avenue, Helena, Montana, to consider the proposed revisions to the Buildings for Lease or Rent Regulations.
